When should I file Chapter 7 Bankruptcy?

You should file Chapter 7 if you:

  ✦  Have more than $10,000 in dischargeable debt 
  ✦  Have a likelihood of a drop in your credit score or have a credit score of 600 or lower
  ✦  Don’t own property that exceeds your state law exemptions 
  ✦  Are struggling to keep up with payments and make ends meet every month
  ✦  Are worried about wage garnishment or being sued for a debt 
  ✦  Earn less than the median income in your state
  ✦  Don’t see any way to pay back your debt over the next 5 years

That being said, there are some situations in which you should wait. In some cases, filing too soon can reduce your exemptions, not allow discharge of certain debts, or give certain creditors the opportunity to go after your family or friends.

Do I qualify for Chapter 7 Bankruptcy? Who can declare chapter 7 bankruptcy?

To qualify for Chapter 7 you have to pass a "means test" 
  ✦  If your current monthly income is less than the median income in your state you automatically pass
  ✦  If it’s higher, you must show it’s still impossible for you to pay off debt. We do this by showing that the allowed monthly expenses wipe out all or most of your disposable income. 

If you fail the means test, you won't qualify for Chapter 7 bankruptcy. You may still qualify for a Chapter 13 bankruptcy or some other repayment plan.

How does Chapter 7 Bankruptcy work?

First, you file a bankruptcy petition with the court. All of your property becomes part of a “bankruptcy estate”

The bankruptcy court notifies all the creditors mentioned in your schedules. This automatically stops their collection actions.

The Bankruptcy court then appoints a trustee to administer the case. The trustee’s job is to make sure that your bankruptcy petition and schedules are accurate and complete and to decide whether and how your non-exempt assets should be administered and used to pay creditors.

Approximately 30 - 40 days after filing the petition, the trustee holds a 341a meeting of creditors to examine the debtor to determine if the information in the petition and schedules is accurate and complete.

Approximately 10 days after the meeting of creditors, the trustee will file a report with the court.
